    Terms of Service

    Term #116

The contract between merchant and customer: return policy, product warranty, payment terms, liability limits, jurisdiction. Consumer protection laws set minimum requirements.

    In practice

Terms of Service are your 'insurance policy.' When a customer claims something didn't work as promised, the ToS determines what they're entitled to. Without clear terms, every dispute becomes a battle. With clear terms: 'per the terms you agreed to, here's the resolution.'

    Common misconception

'No one reads the ToS, so it doesn't matter.' Accepted terms (even via implied consent) are legally binding. In a chargeback dispute, the payment gateway asks for the ToS as evidence. Clear terms plus proof the customer saw them provide strong protection.

    How to fix it

Lots of customer disputes? (1) Check whether the ToS is clear and accessible (not a buried PDF), (2) add a checkbox at checkout: 'I have read and accept the terms of service,' (3) clarify return policy, delivery times, and warranty limits early in the document.

    Example

An electronics store had a 2.1% chargeback rate. Analysis showed 60% were 'not as described' disputes. Adding a detailed spec sheet to the ToS plus a checkout checkbox cut the chargeback rate to 0.8% within 3 months.

    Priority

Update the ToS annually and every time your return policy changes. Required: a visible ToS link in the footer plus an explicit checkout checkbox (not implied consent).
